State High Court to Review Arts Plaza Lawsuit
The California Supreme Court will review a $2.7-million appellate court judgment against the city stemming from the construction of the Civic Arts Plaza, City Atty. Mark Sellers said Thursday.
Amelco Electric, one of many contractors to work on the $86-million project, sued the city for breach of contract when it refused to pay for work done between 1992 and 1995. In July, the 2nd District Court of Appeal agreed with an earlier jury’s decision that the city owed Amelco $2.7 million.
Sellers said the appellate court determined that because there were a number of changes in the project as it was being built, the contract could be ignored by the trial court and the contractor could recover all costs.
