State Order Is Too Late to Save Herons’ Nests

The Coastal Commission issued a cease and desist order to workers trimming trees Wednesday that contained great blue herons’ nests. But the order came too late, authorities said.

The birds are protected but not endangered. The issue of whether Elkor Realty Corp. should be allowed to trim the trees has been

debated by activists and others, said Sheriff’s Lt. Robert Dillard. On Aug. 15, the Department of Fish and Game gave permission for the trimming as long as no nesting activity was observed.

Dillard said it appeared the herons were gone and the nests were empty. But activists insist the birds nest year-round, he said.
