Boy’s Rape, Killing Described at Trial
A 13-year-old boy was sedated, restrained and gagged with his own underwear and duct tape, then raped repeatedly before he suffocated, a prosecutor told jurors Wednesday.
In his opening statement, prosecutor Bob Balfe said Jesse Dirkhising had been restrained on a bed before dying in the assault on Sept. 26, 1999.
If convicted, Joshua Macabe Brown, 23, could be sentenced to death. His roommate, Davis Don Carpenter, 39, described in a police report as Brown’s lover, is also charged with capital murder and his trial is scheduled for May.
