Suit Alleges Negligence in April Train Collision
Burlington Northern Santa Fe Corp., which operated a freight train that smashed into a commuter train here in April, is being sued by 10 victims alleging negligence and willful disregard for their safety.
The suit, filed in Los Angeles Superior Court, claims that the company was negligent and should have invested in an automatic braking system. The plaintiffs say the system could have prevented the collision with a Metrolink commuter train.
The freight-train engineer said he was blinded by the sun and did not see a yellow warning signal.
