In Publisher Settlement, the Suit Done Gone
GEORGIA
The estate of “Gone With the Wind” author Margaret Mitchell and a U.S. publisher have settled a lawsuit over a black writer’s parody of the best-selling novel about the Civil War, the two sides said in Atlanta.
Under the agreement, Alice Randall’s “The Wind Done Gone,” which a court ruled enjoys constitutional free-speech protection even though it appropriates characters from the classic novel, will continue to be published with the label “An Unauthorized Parody.”
The confidential settlement between Houghton Mifflin Co. and the Mitchell Trusts ends litigation that began more than a year ago but preserves future adaptation rights for the two sides, a statement from the parties said.
