The Environmental Protection Agency’s top lawyer said he was resigning to return to private practice in his home state of New Jersey.

Robert E. Fabricant had joined the agency as general counsel to former Administrator Christie Whitman, reprising the role he played while she was the New Jersey governor. He said he will step down Sept. 3.

“Bob has been a trusted advisor for many years, and has played a critical role in my accomplishments,” Whitman said.
