An appeals court agreed to hear Wal-Mart Stores Inc.’s appeal of a judge’s order approving class-action status for a sex-discrimination lawsuit representing as many as 1.6 million current and former female employees.

In a brief order, the 9th U.S. Circuit Court of Appeals in San Francisco did not comment on the merits of the appeal.

If the appeals court does not overturn last month’s ruling by U.S. District Judge Martin Jenkins in San Francisco, the case will become the nation’s largest civil rights lawsuit targeting one company.
