Judge Quashes Big Award in Girl’s Death

A Superior Court judge threw out a $37.5-million verdict awarded to the parents of a girl killed as she walked along a busy roadway after school, and ordered a new trial to determine the award.

The new trial also will determine how the penalty will be shared among the city of Fontana, the teen driver and his parents.

The judge ruled that $37.5 million was excessive but let stand the jury’s decision to hold the city liable because it had built no sidewalks.

Karen Medina, 14, was killed in December 2001.
