From Times Wire Reports

A former police chief has been found “factually innocent” of charges he conspired to obstruct justice in the investigation of his son and two other off-duty officers accused of assaulting two men on the street in 2002.

Superior Court Judge Kay Tsenin ordered that all records of Alex Fagan Sr.’s indictment, including his police mug shot, be destroyed.

Fagan was one of seven high-ranking San Francisco police officials indicted on charges last year that they conspired to obstruct an investigation into allegations that the three officers beat up two men over a bag of steak fajitas in November 2002. The three officers, including Alex Fagan Jr., still face assault charges.
