Defense lawyers moved to dismiss the criminal indictment against Adelphia Communications Corp. founder John Rigas, two of his sons and a fourth former executive, citing one witness’ inaccurate testimony.

On March 15, Judge Leonard Sand declined a defense request to strike mistaken testimony delivered by former director Dennis J. Coyle, but rebuked prosecutors for allowing the error.

Coyle’s testimony reflected a misunderstanding about whether the Rigases violated Adelphia’s requirements in borrowing money from the company.
