BMW of San Francisco will pay $4.4 million to about 200 current and former employees under a settlement with the National Labor Relations Board.

German Motors, which does business as BMW of San Francisco, “unlawfully implemented new terms and conditions of employment of union-represented employees in 1989,” the National Labor Relations Board said Tuesday. The car dealer violated labor laws by invalidly declaring an impasse during contract negotiations, the agency said.

The District of Columbia Circuit Court of Appeals in January agreed with the agency’s findings that BMW of San Francisco broke the law.

“German Motors has begun to comply with the court-enforced board order, and they will be in full compliance when all of the monies are distributed,” Joseph Norelli, regional director of the National Labor Relations Board, said in the statement. “I am pleased to see that the employees are being compensated.”

A call to BMW of San Francisco seeking comment wasn’t returned.
