We will never see former Deputy Assistant Atty. Gen. John C. Yoo do the perp walk for his role in enabling torture because retroactive immunity from such charges was granted by the Military Commissions Act, signed by President Bush in 2006. However, Yoo will not be protected by the act if he travels abroad because the Nuremberg trials established that enabling lawyers can be convicted of war crimes.
