Siblings guilty in sailor’s ’93 death

A federal jury Tuesday convicted two brothers of first-degree murder in the 1993 robbery-killing of a sailor at the 32nd Street Naval Station.

David and Leonard Scaggs were convicted of fatally shooting sailor Mark A. Smith, 23, as he walked away from an automated teller machine on base with $80. The killing was investigated by the “cold case” unit of the San Diego Police Department and the district attorney’s office after witnesses came forward.

A third defendant, Maurice Overton, pleaded guilty in January. Leonard Scaggs served in the Navy and had access to the base, prosecutors said. The Scaggs brothers are set to be sentenced Sept. 15.
