A New York state Supreme Court judge on Tuesday ruled in favor of Dan Rather in key motions regarding his lawsuit against CBS, allowing the former anchor to pursue a fraud claim against his former employer.

Justice Ira Gammerman had twice tossed out Rather’s claim of fraud (the $70-million lawsuit against CBS said Rather had been forced out of the network). But on Tuesday, Gammerman accepted an amended fraud claim submitted by Rather’s attorneys and said he wants to see the case move forward to trial in the next four months.

CBS has appealed to a state appellate panel to dismiss the case.
