Barry Diller is no fan of BarryDriller

Barry Diller wants to hammer Barry Driller.

The media mogul has filed a suit against Alki David, the owner of the digital platform BarryDriller.com, a company that offers consumers access to broadcast television signals via Internet-enabled devices.

Diller is a backer of Aereo, a company that does the same thing.

The difference is that David’s previously efforts in this arena have previously been thwarted by the courts while Aereo is still up and running despite challenges from big broadcasters including Fox, CBS, ABC and NBC.

In the suit, which describes Diller as “one of the most well known business leaders in the United States,” Diller accuses David of using the Barry Driller name to “mislead consumers into believing that there is an association” between the two when there is no relationship.

Diller alleges that David is “seeking to unfairly capitalize on the success of the new business venture” and “mislead the public into believing that defendants’ service has been judicially sanctioned.”

Filed in U.S. District Court in Los Angeles, Diller is asking that BarryDriller.com be shutdown and that Diller be rewarded punitive damages “to compensate him for the harm he has suffered.”

Diller may have to take a number. Fox, CBS, NBC and ABC have also filed suits against BarryDriller.com, not because of the name but because they think the service, like David’s FilmOn, is guilty of stealing their intellectual property. That’s the same reason they’re trying to shut down Diller’s Aereo.

David called Diller’s suit ridiculous and added that the mogul “hasn’t had this much attention in 30 years” and that “he should be grateful for the homage to him.”
