Colorado theater shooting suspect’s trial delayed again

The death penalty trial of James E. Holmes, the man accused of opening fire on a packed Colorado movie theater in 2012, was delayed again Monday.

This marks the fifth time the trial has been postponed.

In his ruling, District Judge Carlos Samour granted the defense’s request for more time to review a sanity evaluation conducted on Holmes. There have been multiple such evaluations, and those, in part, have added to delays.

Jury selection was scheduled to begin in December but has been pushed back to Jan. 20. Samour said in his ruling that a few of the victims preferred the change to keep trial activities away from the holidays.

Still, the majority of victims do not want more delays, he said in the ruling.

Holmes pleaded not guilty by reason of insanity to killing 12 people and injuring dozens more in the shooting at a packed movie theater in Aurora during a midnight showing of “The Dark Knight Rises.”

Authorities said Holmes was dressed in full body armor and used a form of tear gas on the crowd before opening fire with multiple guns.
