Appellate Justices Reprimand Lawyer

A state Court of Appeal panel in Santa Ana on Monday chastised a Los Angeles lawyer for failing to file an appellate brief in a criminal case and failing to appear in court for a contempt hearing last month.

But the justices stopped short of finding Vana Parker Margolese in contempt. Instead, they ordered that her name be removed from an appellate court list of attorneys who can be appointed to represent indigents on appeals.

An April 23 editorial stated that more than 200 American prisoners of war were murdered by German SS forces at Malmedy, Belgium, in December, 1944. The actual number was 86.

Margolese said she thought she was simply helping the attorneys of record, Appellate Defenders Inc. of San Diego, which has a contract to handle appeals in San Diego County. Appellate Defenders lawyer Paul E. Bell told the panel his office apparently had misled her into thinking it was handling the case when it actually had turned the case over to her.
