It may be several weeks before the district attorney’s office decides whether to prosecute Los Angeles Police Officer Rodney W. Kelley, accused of fatally shooting a Cuban immigrant in the back after the man beat Kelley with his own police baton. Deputy Dist. Atty. Larry Diamond said his office is still reviewing evidence in the case and hopes to decide before the end of the year whether to file criminal charges against Kelley, 26. A Police Department tribunal found the four-year veteran guilty of “unnecessarily discharging” his revolver at Miguel Angel Herrera, 30, and of lying to investigators afterward. Police Chief Daryl F. Gates has until Monday to decide whether to uphold the tribunal’s recommendation that Kelley be fired.
