Fallbrook High School illegally suspended two students who published an underground newspaper and distributed it at the school last fall, a San Diego Superior Court judge in Vista ruled Friday.

Judge Lawrence Kapiloff also ruled that it was not illegal for one of the students, Daniel Gluesenkamp, to surreptitiously tape record a meeting with the school’s principal.

Fallbrook Principal Henry Woessner suspended juniors Gluesenkamp and Philip Tiso for several days last fall after they published the first issue of their newspaper, The Hatchet Job.

School officials contended that the newspaper contained obscene and libelous material, and said the pair had violated policy by not permitting administrators to review the publication before distributing it on campus.

The students’ countersuit seeking damages is still pending.
