The City of Oakland has asked the California Supreme Court to overturn the most recent state appellate ruling in the city’s eminent domain case and order the return of the NFL’s Raiders franchise from Los Angeles to Oakland. The appeal is the latest move in the state-endowed powers of property condemnation to take over the Raiders franchise. The state Supreme Court now has 90 days to decide whether to hear Oakland’s appeal. Oakland has challenged the state Court of Appeal’s finding that the commerce clause of the U.S. Constitution bars the city’s eminent action to acquire the franchise.
