A San Diego Superior Court Judge on Thursday denied a request by a North County citizen’s group to keep a proposal to incorporate the San Dieguito area off the June ballot.

Judge Mack P. Lovett denied a request by Citizens for Informed Choice on San Dieguito that would have required the completion of environmental and “sphere of influence” studies before the incorporation measure could go to voters.

Lovett also denied an accompanying motion for a preliminary injunction prohibiting the measure from appearing on the ballot and in voter information booklets.

David Mulliken, the group’s attorney, argued that passage of the cityhood measure on June 3 would cause several complex reorganizations of sewer, water and other special districts. Olivenhain, Encinitas, Leucadia and Cardiff are the communities that would be combined to create a 26-square-mile city of 45,000 residents.

Mulliken said the group isn’t trying to stop the incorporation effort indefinitely, just delay it until residents know all the projected effects.
