The convicted felon who recently opened an unlicensed shelter for homeless youths in the Gaslamp Quarter must vacate the premises by early next week, a San Diego County Superior Court judge has ruled.

Judge Wesley Buttermore Jr. ordered the eviction of Nathaniel G. Jones from the two-story building at 520 6th Ave., where since April he has operated a facility called Young Active People.

Jones, 24, leased the building and opened the shelter just weeks after he was released from County Jail, where he served seven months of a one-year sentence for attempted auto theft, a felony.

Buttermore ruled Tuesday that Jones had failed to pay any rent to his landlord, Robert Osterberg. The judge rejected Jones’ defense that he was within his rights to withhold payments because the building was infested with bugs and vermin. Jones produced roaches collected in the building as evidence in court.

Herb Young, attorney for Osterberg, said he would ask Jones to voluntarily vacate the building over the weekend. Otherwise, he said, county marshals will evict Jones on Monday.

State licensing officials have issued a notice that Jones is illegally operating a community care facility without a license.
