Reggie Jackson of the Angels won’t face criminal charges because of his involvement in a May 3 scuffle with a miffed autograph-seeker in a downtown bar, the Milwaukee County district attorney said Thursday.

“All the evidence indicates that neither man struck the other with his fist, kicked the other or used a weapon of any kind,” District Attorney E. Michael McCann said in a statement.

The case was referred to the city attorney’s office for review.

“Cases such as this are handled in the usual course of business by the city attorney’s office rather than by the district attorney’s office, and no special, different handling ought to be given this matter,” McCann added.

The incident occurred after a game between the Milwaukee Brewers and the Angels.

Jackson, 40, and three teammates were eating at Major Goolsby’s, a popular drinking and eating establishment across from the hotel where the Angels were staying, when they were approached by 26-year-old Donald Weimer of Racine, Wis.

Weimer, who later admitted to drinking more than a six-pack of beer that day, asked Jackson for an autograph.

“Jackson refused Weimer’s request for an autograph, offending Weimer, who later returned to Jackson’s table and threw a torn-up paper plate onto the table with at least a portion landing in Jackson’s food,” McCann said.

“There is a sharp conflict in the statements between a number of persons in the tavern as to whether Jackson pushed or shoved Weimer under the table or whether Weimer simply fell after Jackson let go of him.”
