The judge who reversed former boxer Rubin (Hurricane) Carter’s triple-murder conviction was mistaken when he claimed that Carter was at the peak of his career in 1966 and thus unlikely to get involved in a barroom shoot-out, prosecutors in Newark, N.J., said.

Saying they were attempting to correct the record of the case for an impending appeal, the prosecutors said that Carter was well past his prime when the shootings occurred.

U.S. District Judge H. Lee Sarokin freed Carter, who is black, from Rahway State Prison in November after ruling that prosecutors had improperly injected race as a motive in Carter’s 1976 murder trial. He served 19 years in jail.
