A negligence suit was filed Tuesday against the City of San Diego and a former police reservist who shot at a car while driving on Interstate 8.

Randall John Zummo, 33, of San Diego filed the suit in San Diego Superior Court against David Watson, 33, of Santee, who will be sentenced Friday for shooting at Zummo.

Watson was a police reserve officer when he shot at Zummo’s moving van Aug. 31, 1985, after Zummo’s passenger allegedly threw trash out his window, hitting Watson’s car.

Watson claimed self-defense, but he was convicted by a jury Feb. 28 of two counts of assault with a deadly weapon and carrying a loaded gun in his car. The bullets missed Zummo and passenger Robert Tidmore, 26, by inches.

The suit alleges that “the city is at fault in negligently hiring” Watson and “entrusting him with a firearm.”

No amount of damages was cited, but Zummo filed an earlier claim against the city for $200,000.

Zummo’s wife, Ronda, 27, who was driving another vehicle ahead of her husband, also joined in the suit.
