Nursing Home Chain Has Mixed Day in Court
SAN FRANCISCO — A major nursing home chain cited by the state for more than 50 health and safety violations in 15 months, including five cases involving deaths of patients, won one legal skirmish Thursday but lost another in licensing disputes.
Beverly Enterprises, the nation’s largest nursing home operator, was allowed to continue running three facilities in Mendocino and Sonoma counties for which the state Department of Health Services said the company was not licensed.
However, San Francisco Superior Court Judge Lucy Kelly McCabe turned down the company’s request for an injunction to prevent the state from denying licenses to seven new or recently acquired facilities.
Beverly argued that the state was unfairly denying it the licenses because of the alleged violations at other sites.
