A suit by two former Garden Grove firefighters is challenging an old legal principle that prevents public safety workers from suing for damages if injured on the job.
Capt. Richard Salazar, 59, and Roy Chastain, 50, took medical retirements from the Garden Grove Fire Department after suffering severe burns Nov. 29, 1980, when a fire in a barbecue fueled by propane gas exploded.
Salazar and Chastain contend in a lawsuit before Orange County Superior Court that the manufacturer had made a defective barbecue grill. Because that danger wasn’t known, they contend, their case presents an exception to the legal rule that firefighters and police officers can’t sue for injuries suffered in the line of duty.
