David Matthew Tucker pleaded innocent Friday to murder in the death of a man watching a fight outside a disco in Marina Village.

Tucker, 22, of Linda Vista was ordered held in County Jail in lieu of $250,000 bail by San Diego Municipal Judge Charles Hayes.

A stray bullet hit Charles Bryant, 31, in the back as he ducked into a car to avoid getting shot during the altercation.

Tucker is also accused of trying to murder Michael Moller by shooting at him, and of assault with a deadly weapon in trying to run over him.

Deputy Dist. Atty. Sally Williams said Moller did not know Tucker and she believed the fight stemmed from some remark between the two.

The judge cited Tucker’s apparent instability and flight risk as reasons for the high bail.

Williams said that Moller, 25, is the same man who was shot at and assaulted by off-duty deputy sheriffs on Dec. 22, 1981, in a highly publicized case. Moller and a friend were assaulted by two deputies who had just finished their jail duties and were eating at a taco shop in Hillcrest. Deputies Alan Wittig and Charles Bailey were convicted of assault with a deadly weapon, sentenced to three months in jail and fired from the force.
