A $4-million wrongful-death lawsuit has been filed in San Jose by the daughter of one of two couples killed last month when they were hit by a truck while bicycling. The Santa Clara County Superior Court suit names as defendants Catherine Ann Miller, 18, of Gilroy, the driver, and Fortino Winery, owner of the truck. Miller has been charged with four counts of misdemeanor vehicular manslaughter. The lawsuit was filed by Teresa Woodland, 22, of Morgan Hill, whose parents, Lawrence and Donna Mallery, were killed. Also killed were Victor and Darlene Amerio of Los Altos. Investigators said the accident occurred as Miller reached for a cassette tape on the truck’s floorboard. The truck drifted onto the shoulder and hit the four cyclists, officers said.
