Whittier : Dumping Case Delayed
The toxic-waste dumping case against the City of Whittier and four of its top officials was postponed this week for the fifth time until Feb. 9.
Los Angeles Municipal Judge Alban I. Niles, who was recently assigned to handle the case, said he needed more time for review. The city was charged in mid-September with a felony count of dumping hazardous wastes--paint residues and thinners--in an open trench in the city yard. The four city officials were also charged with a misdemeanor count involving the same allegation.
At the February hearing, Niles is expected to rule on a request by defense attorneys to move the case from downtown Los Angeles to Whittier. Once the jurisdictional issue is resolved, a preliminary hearing could be held.
