Sheriff Reveals Names of Those on 1983 Gun Permit Lists

After a long court battle, Sheriff Brad Gates on Friday released copies of all Orange County concealed-weapon permits issued in 1983, revealing for the first time in his 13-year tenure the names of those he has authorized to carry handguns.

The permits were disclosed in connection with a lawsuit by CBS Inc. against Gates. The network’s lawyers argued that the information should be public so it can be determined whether the sheriff has abused his discretion in issuing the permits.

In a list accompanying a June 13 story in The Times, Russell Thorne Skattum of Huntington Beach was mistakenly listed by the Orange County Sheriff’s Department as among county residents whose 1983 gun permits were canceled, revoked or denied. Actually, Skattum’s concealed weapon permit was renewed in 1983, but he allowed it to expire the following year, according to Sheriff’s Lt. Russ Elsner. In 1985 Skattum applied for a new concealed weapon permit, but it was denied because the Sheriff’s Department determined that Skattum no longer needed it, Elsner said.

The lawsuit was filed in 1983, requesting a court order forcing Gates to release copies of all concealed-weapon permits and applications for permits submitted to him that year. Among the permit holders listed in the information released Friday were many law-enforcement officers, lawyers, deputy district attorneys and judges.

There were also businessmen, private investigators, doctors and dentists who said they needed the weapons for self-protection, because of threats or because they transported cash and other valuables.

The 501 documents released Friday included 181 concealed-weapon permits that were active in 1983 and remain active, 225 permits that expired during 1983 and 95 applications for permits that were canceled, revoked or denied.

A spokesman for Gates said the sheriff would have no comment on the gun permits, which were made public after Orange County Superior Court Judge Robert Polis inspected each document and deleted some information.

“If there are questions on these (permits), nobody’s going to answer them,” Lt. Richard J. Olson said. “This is what the judge deemed to be public information and nothing else.”

Olson said answering questions about the permits might inadvertently reveal confidential information about the permit holders.

Preston Guillory, a private investigator who has sued Gates for denying him a gun permit in 1978, said Friday he was “pleased that the list is coming out.

“But the true story lies prior to 1983,” Guillory said. “The real story is 1975-79.”

Guillory said that in the mid-1970s there were more than 900 gun permits issued annually by Gates.

“Who were those 900 people? Those were the people who put him in office,” Guillory said. “We can prove it.”

However, among the 501 permit holders from 1983 who were identified Friday, just 42 individuals also contributed to Gates’ reelection campaigns, according to a comparison of the information released and Gates’ campaign contribution statements throughout his tenure as sheriff.

“I expect that when the records from 1975 forward are finally public record, we’ll see an incredibly higher correlation (of gun permit holders and Gates campaign donors),” Guillory said. “We know he cut back tremendously from 900 permits. The only reason he cut back was because we sued.”

Sandy Michioku, a spokeswoman for the state Fair Political Practices Commission, said Friday that under the Political Reform Act it is not necessarily a conflict of interest for an elected sheriff to issue gun permits to people who donate to his campaign.

“The conflict-of-interest provisions wouldn’t necessarily apply,” she said. “Campaign contributions are not considered a source of income, which is the basis for conflict of interest.”

Guillory said his attorney has been granted access to all gun permits issued by Gates since his election as sheriff in 1974. But Guillory said his attorney is barred by court order from disclosing information from those permits.

Judge Polis ordered the 1983 documents released after October’s state Supreme Court ruling that a sheriff could no longer keep confidential all information on concealed-weapon permits.

The gun permits are good for one year and are issued at the discretion of chiefs of police and county sheriffs. In Orange County, most police departments send gun permit applicants to Gates. The numbers have continued to dwindle since 1983; there are now about 130 individuals authorized by Gates’ office to carry concealed weapons.

Under state law, chiefs of police and county sheriffs have almost total discretion to issue gun permits to anyone deemed “of good moral character” who has “good cause” to carry a concealed weapon.

Those standards have been subject to widely differing interpretations. In 1985, for instance, 11 permits were issued in San Francisco, while 3,418 were issued in sparsely populated Shasta County.

Olson said Judge Polis will meet next week with representatives of the Sheriff’s Department to issue guidelines for the release of gun permit records from the years other than 1983.

The state Supreme Court ruled in October, 1986, in a lawsuit by CBS Inc. against Los Angeles County Sheriff Sherman Block that gun permits are public documents and cannot be kept secret. A separate CBS lawsuit was filed in 1983 against Gates, who had rejected requests by the network’s affiliate, KCBS-TV, for permission to review the files.

Endanger Holders

Gates’ attorney, Assistant County Counsel Arthur C. Wahlstedt Jr., argued that the information should be kept confidential because disclosure could endanger holders of concealed-weapon permits, who, he said, often required the weapons for self-defense.

A representative of the California Reserve Peace Officers Assn., whose members held 80 of the 1983 gun permits, also sought to keep the permits secret for the safety of the officers, who often work undercover.

Polis said he generally deleted only the business addresses of reserve deputies, home addresses of law-enforcement personnel, “any truly personal, confidential” information and data that would “increase the risk of vulnerability” for permit holders.

In some cases, Polis said, he also deleted the reason stated on an application for requesting permits when he believed releasing that information “could increase the individual’s vulnerability to attack.”

REVOKED, CANCELED GUN PERMITS

Individuals whose gun permits were canceled or revoked in 1983 and individuals who were denied gun permits. There are many reasons for canceling, revoking and denying gun permits.

For example, permits can be canceled if they were granted for use by a reserve peace officer who no longer serves in that capacity. Permits can be revoked if the holder violates restrictions on the permit.

Among the restrictions are “unjustified display of a deadly weapon,” being under the influence of drugs or alcohol or “discussing the issuance of the permit with anyone other than law enforcement officials.” Permits can also be denied if the sheriff determines the applicant is not of “good moral character.”

The list was released Friday by the Orange County Sheriff’s Department in connection with a lawsuit filed by CBS, Inc.
