The University of Washington’s athletic drug testing program was ruled unconstitutional by a judge in Seattle who issued a temporary restraining order against the National Collegiate Athletic Assn. testing UW athletes for drugs, an American Civil Liberties Union official said.
The ruling by King County Superior Court Judge George T. Mattson went beyond what the ACLU had sought in striking down the university’s testing program, said Kathleen Taylor, executive director of the ACLU of Washington.
Taylor said Mattson found the Washington testing program unconstitutional because it violates the students’ right to privacy. Mattson also said that before a search can be considered for an individual, there must be grounds to suspect that person. The Washington program had sought annual testing of all athletes.
