Forcing fundamentalist Christian children to use textbooks that offend their religious beliefs does not violate their constitutional rights, a federal appeals court panel ruled. The panel returned the case involving the Hawkins County, Tenn., public schools back to the trial judge with orders to dismiss it. The court reversed also the judge’s order that the public schools pay private school tuition and other costs to the families that brought the suit. An attorney said the families would appeal the decision. Among the books that the families objected to was “The Wizard of Oz.”
