A judge Friday granted a delay in the custody hearing for Brian Batey, the 16-year-old at the center of a long legal fight between his fundamentalist Christian mother and late homosexual father.

Superior Court Judge Sheridan Reed granted the delay in part because Batey was ill, said Jordan Lawrence, a spokesman for Concerned Women for America, a Washington, D.C., group that has backed Betty Lou Batey, Brian’s mother, in the custody battle.

Brian Batey told United Press International in a telephone interview from Palm Springs Friday that he was suffering from a cold and fever.

Young Batey has said he wants to remain in Palm Springs, where he has been living with Craig Corbett, his father’s homosexual lover. Corbett wants to make permanent the temporary guardianship he was granted after Frank Batey died June 26 of AIDS complications.
