A federal judge criticized the state Board of Prison Terms and ordered a new parole hearing for John L. Spain, convicted of a 1966 murder-robbery in Los Angeles when he was 17. U.S. District Judge Thelton Henderson ordered the parole board to hold a new hearing within 10 days because it had violated earlier court rulings by considering Spain’s 1976 murder conviction in a San Quentin Prison uprising, Spain’s attorney, Dennis Riordan, said. Henderson has ruled on two occasions that the second murder conviction should not be part of the parole board’s record because he has thrown it out of court and ordered a new trial.
