Walt Disney Co. and Amblin Entertainment Inc. have filed suit against an apparel company here, charging unauthorized manufacture, distribution and sale of apparel bearing the likeness of three characters from their popular animated film, “Who Framed Roger Rabbit.” Under a court order resulting from the suit, six United States marshals seized more than 1,500 T-shirts displaying Roger Rabbit, his “toon” wife, Jessica Rabbit, and Benny the Cab, plus other infringing items. The action filed in the U.S. District Court in Milwaukee names Concert Shirt Inc. and its owner, Jack Kupper, charging copyright and trademark violations and unauthorized use of characters and titles present in “Who Framed Roger Rabbit.” The suit seeks an injunction preventing further manufacture or sale of the T-shirts.
