An Ohio appeals court has upheld the 1986 aggravated assault conviction of country singer Johnny Paycheck for shooting another man in a barroom, but has ordered a lower court to reconsider the 9 1/2-year prison sentence. The Ohio 4th District Court of Appeals on Tuesday said the trial court erred in imposing its stiff sentence without first holding a pre-sentencing hearing after the conviction. Paycheck claimed self-defense in his 1985 confrontation with Larry Wise, then 37, in a Hillsboro, Ohio, tavern, but Wise said Paycheck shouted at him and then shot him, grazing his skull.
