Waiver Theater

Recognizing the fact that scenery, costume and lighting designers are required to do work that in many of the top-ranking “waiver” arenas can be equal to mounting an Off-Broadway production (sometimes even more elaborate), United Scenic Artists Local 829 initiated discussions with some of the Equity Waiver Theater Operators in 1985.

From these meetings we developed the Western Region Standard Design Agreement, which includes protection when working under these circumstances as well as provisions for a negotiable fee and a producer’s contribution to our pension and welfare plan. It should be noted that we do our creative work in this situation for a lot less than our normal fee.

The Western Regional USA 829 position is that no designer should work in an Equity Waiver situation without being paid something . . . “up front.”
