The debate about no-fault insurance has overlooked a key point. Under the fault system of liability, a driver pays through his insurance for the damages that he is likely to cause to others. With no-fault insurance, a driver pays for the damage that others are likely to cause him.

Under no-fault, drivers who are careful and unlikely to damage others subsidize drivers who are less careful. No-fault automobile insurance arose in the ‘60s as a liberal political plan for uninsurable drivers. The idea has neither improved nor changed with age.
