With the present composition of the Supreme Court reflecting a 6 to 3 rejection of the concept of the protection of individual rights, Caplan’s conclusion is already accomplished. The court has been transformed--and so has this country’s law.
The protection of individuals in their dealings with the government awaits an American Magna Carta far, far down the road.
