A personal-injury lawsuit on behalf of twin boys allegedly molested and abandoned at a Del Mar motel last month has been filed in Vista Superior Court, seeking unspecified monetary damages from their mother and her boyfriend.

The lawsuit, filed Monday by El Cajon attorney Samuel Hornreich at the request of Dennis Ford Jr., the boys’ uncle, alleges that Dorothy DeSimone, 25, was negligent in supervising her children and exposed them to danger by allowing them to be cared for by her boyfriend, Thomas McCoy, 27.

The suit also alleges that McCoy intentionally committed assault and battery against the children.

DeSimone, of Oceanside, has pleaded innocent to felony child abuse charges. She was arrested when she visited the twins at Children’s Hospital in San Diego, where they had been taken for treatment of cuts, bruises and alleged sexual molestation.

McCoy was arrested last week in Laughlin, Nev., on a $500,000 felony child-abuse warrant issued in San Diego. Las Vegas police said McCoy was expected to sign papers today waiving his extradition rights.
