Santa Ana : Car Dealer Will Settle Charges for $122,910

A local car dealership has agreed to pay $122,910 to settle charges that it misrepresented the histories of some of its used cars, the Orange County district attorney’s office said Monday.

Santa Ana Lincoln Mercury, while agreeing to pay fines, restitution and the cost of investigation in the case, denied any wrongdoing in the settlement.

Department of Motor Vehicles investigators charged that the dealer bought used cars at auction from such companies as Hertz and Avis, then falsely sold them to unsuspecting buyers as “executive cars, cars previously owned by private parties, or cars just used around the dealership.”

As part of the settlement, the Lincoln Mercury dealer also has agreed to a permanent injunction requiring it to give all buyers written notice of the histories of its used vehicles.
