Malibu : Group Wants Suit Set Aside

A citizens group has asked a judge to set aside a lawsuit filed by a Malibu real estate broker who wants to prevent county officials from setting a cityhood election in Malibu until there are reasonable assurances that a sewer system will be built there.

The Malibu Committee for Incorporation this week intervened in a lawsuit by real estate broker John Corrodi, asking Superior Court Judge Dzintra Janavs to throw out the case.

The judge has scheduled a hearing Jan. 16, the same day she is to hear further arguments in a lawsuit filed by the incorporation committee and another group, the Malibu Township Council, in their attempt to force the Board of Supervisors to set an election.

Corrodi has argued that the Local Agency Formation Commission improperly approved a request by cityhood supporters to seek incorporation and that the supervisors should be prevented from setting an election until there are guarantees that the county’s long-sought sewer system will be built.
