SHORT TAKES : Singer Wins Round Vs. Disney

Singer Peggy Lee won a summary judgment against Walt Disney Productions in a suit in which she claimed Disney needed her approval before releasing the videocassette version of “Lady and The Tramp.”

Superior Court Judge William Huss granted a request for the judgment establishing Disney’s liability in the case, Daily Variety reported Wednesday.

Neil Papiano, Lee’s attorney, said the court will schedule a trial to determine damages. Lee is seeking $12.5 million.

Lee provided voices and co-wrote songs for the 1955 animated classic. Disney has sold about 3.2 million cassettes of the movie at a wholesale value of between $45 million and $50 million, Daily Variety said. Theatrical rentals have totaled about $40.25 million, it said.
