Malibu Cityhood Backers Sue to Block Delay

Supporters of cityhood for Malibu sued the county Board of Supervisors Friday in a bid to prevent the board from delaying the coastal community’s incorporation if it is approved by voters in June.

The board, under orders from a judge, has set a June 5 cityhood election for Malibu.

However, in the same resolution the board included language that would delay the actual incorporation for more than nine months after the election, until March 28, 1991.

The Superior Court suit filed by the Malibu Committee for Incorporation challenged the supervisors’ contention they have the jurisdiction and legal authority to delay the effective date of incorporation.

Neither the supervisors nor attorneys for the county could be immediately reached for comment on the suit.
