FULLERTON : Anti-Noise Measure Summary Accepted

A residents group intent on circulating a measure against traffic noise has agreed to accept a new ballot summary released this week by the city attorney, the group’s leader said Tuesday.

The second version of the summary does not contain the biased wording of the original summary written in January, Save Our Bastanchury leader Mary B. Homme said.

City Atty. R.K. (Kerry) Fox released the second summary Monday. A Superior Court judge had ruled in March that the wording of Fox’s first summary inappropriately argued against the noise initiative.

The summary is important because it must appear at the top of the petitions circulated in a bid to qualify the measure for the ballot. To place the measure on the November ballot, members of Save Our Bastanchury must collect about 6,000 signatures representing 10% of the city’s registered voters.

The measure should begin circulating May 25, Homme said. The group will publish the text and summary of the measure in a local legal newspaper May 24, as required by state election law, she said.

The measure is aimed at halting almost all street improvements in Fullerton if resulting traffic would create noise above the limits outlined in the city’s General Plan. If the measure passes, city officials have said, nearly all future street improvements would be impossible without building huge sound walls or taking other expensive measures to reduce sound.
