Kinison’s Ex-Bodyguard to Be Retried for Rape
Los Angeles County prosecutors said Tuesday that they will retry Sam Kinison’s former bodyguard on charges that he raped the entertainer’s girlfriend after escorting the comedian to his Nichols Canyon home.
Los Angeles Superior Court Judge Dino Fulgoni ordered Unway Lemar Carter to return to court Dec. 4 for the setting of a trial date. On Oct. 25, a Superior Court jury deadlocked in favor of acquittal on five felony charges, including three rape counts, lodged against Carter.
After a night of partying, authorities allege, Carter helped the intoxicated comedian to his home, put him to bed and then raped Kinison’s girlfriend repeatedly. Carter testified in the first trial that Kinison’s girlfriend initiated the sex.
