MISSION VIEJO : Building Freeze to Be Discussed

A building moratorium that would freeze housing construction in the city for at least 45 days will be discussed at a public hearing tonight.

The moratorium was proposed because of a legal conflict between the city and the Mission Viejo Co.

The city’s newly approved General Plan designates open space on Mission Viejo Co. land. But that contradicts a development pact reached between the company and the county just days before Mission Viejo’s incorporation in 1988. The Mission Viejo Co. also claims that building moratoriums are not permitted according to the development agreement. The development firm has also filed a lawsuit against the city, claiming inaccuracies in the General Plan, passed by the council in October.
