Prime Computer Inc. Sues Competitor: The Natick, Mass., firm sued its Costa Mesa competitor, Primetime Software Inc., for trademark infringement and unfair competition involving the defendant’s use of the “prime” designation on its products. In the federal lawsuit, Prime Computer said Primetime was refused permission to register its name with the U.S. Patent and Trademark Office in 1989 after the plaintiff filed a notice of opposition. Nonetheless, the suit complains that Primetime has continued to operate under the same name, an alleged violation of the plaintiff’s patent on the “prime” trademark. The suit seeks an injunction against Primetime. (Case No. 91-0642. Filed Feb. 5).
