Two causes of action in the $32.5-million lawsuit filed by Lucille Gathers and members of her family against Loyola Marymount University and 13 other defendants were put back in the suit by a Los Angeles Superior Court judge.
Commissioner Abraham Gorenfeld reversed an earlier decision and will allow the family to sue for both negligent infliction of emotional distress and conspiracy in the suit that is scheduled for trial on Sept. 3.
The suit stems from the March 4, 1990, death of Loyola basketball player Hank Gathers.
